Terms of Service

Starter terms. Have a lawyer adapt these before signing international clients — jurisdiction, IP assignment and payment terms are where the money is.

Scope

Work is defined in a written statement of work. Anything outside it is a change request and is quoted separately.

Fees and media spend

Retainers are invoiced monthly in advance. Media spend sits on the client’s own card and account unless agreed otherwise in writing. We never take ownership of a client’s ad account.

Ownership

On full payment, the client owns the creative, code and accounts we produce for them. We keep the right to show the work in our portfolio unless an NDA says we cannot.

What we do not promise

We do not guarantee a specific ROAS, ranking or revenue figure. We guarantee the process, the reporting and the working hours. Any agency that guarantees a number is quoting you a number it does not control.
